 » Six oppositions dont celle de la Municipalité de Moutier, de la Commission scolaire, et une collective munie de plus de 800 signatures. L’intention de l’opérateur Salt d’installer une antenne de téléphonie mobile dans un quartier résidentiel de la ville n’a pas été accueillie avec enthousiasme à la fin de l’année 2017. Et c’est un euphémisme. Voisins, mais aussi et surtout parents s’étaient inquiétés de la proximité de l’antenne – prévue sur la toiture d’un immeuble sis à au numéro 1 de la rue des Chênes – avec l’école de Chantemerle. En cause notamment: les rayonnements non ionisants (RNI), dont les effets sur l’organisme font l’objet de controverse. Et d’en appeler au principe de précaution.

Site bâti «harmonieux» La Préfecture du Jura bernois, dans sa décision rendue le 4 mars, a renoncé à octroyer à Salt un permis de construire. Son verdict repose cependant sur des critères essentielle ment esthétiques, donnant raison à un préavis demandé à la Commission cantonale pour la protection des sites et du paysage (CPS). La Préfecture admet que l’antenne ne s’intègre pas et altère les qualités existantes d’un site bâti particulièrement harmonieux qui nécessite une protection spécifique, selon les termes utilisés. Elle relève en outre que si le développement des réseaux de téléphonie mobile est également d’intérêt public, les concessions en la matière ne donnent pas un droit à implanter l’installation à un endroit précis. La commune étant fermement opposée au projet, celle-ci aurait dû jouer un rôle de partenaire actif dans la recherche d’un site adéquat, ce qui n’a pas été le cas en l’espèce.

Pas sur ce site Conseiller municipal et président de la Commission scolaire, Pierre Sauvain a pris acte du refus d’octroi du permis de construire. «Nous n’étions pas opposés strictement à l’installation d’une antenne. C’est bien le lieu qui posait problème en vertu des risques. Nous ne connaissons que peu l’effet de ces rayonnements», souligne-t-il. À ce sujet, la Préfecture du Jura bernois rappelle que la Suisse a pris des mesures préventives en adoptant ce que l’on appelle les valeurs limites d’installation. Un rapport officiel fourni en septembre 2017 par le beco Economie Bernoise considère que la station de base pour téléphonie mobile remplit les exigences légales, que la valeur limite est respectée d’après les calculs dans tous les lieux à utilisation sensible. «En se basant sur ce rapport, il n’y a aucun élément qui permette de déduire de la fiche de données relative aux rayonnements non ionisants une interdiction de l’implantation du projet litigieux à cet endroit», note la Préfecture.

S’agissant du principe de précaution, qui stipule que l’absence de certitude scientifique ne doit pas retarder l’adoption de mesures préventives en cas de danger grave et irréversible, le Tribunal fédéral estime que les valeurs limites contenues dans l’Ordonnance sur la protection contre le rayonnement non ionisant (ORNI, 1999) tiennent suffisamment compte des incertitudes. Il reconnaît toutefois les lacunes des données scientifiques à propos des effets non thermiques sur la santé… « 

Avertissement Léon Warnier, juriste et électrohypersensible, conseille des opposants concernant des projets d’antennes partout en Suisse, y compris à Moutier. Selon lui, de nombreux scientifiques estiment que les valeurs limites actuelles ne protègent pas la population. Alertant sur la montée en puissance exponentielle de la pollution électromagnétique, le spécialiste signale que la communauté médico-scientifique sans conflit d’intérêts exige d’urgence la reconnaissance de l’électrohypersensibilité (EHS) qu’elle considère comme une maladie annonciatrice d’une pandémie mondiale. Le 2 avril à 18 h 30, Léon Warnier donnera à Moutier une conférence intitulée «Antennes, santé et responsabilités».

Pakistan: Hazardous radiation: PHC directs EPA to remove 20 cellular towers

PESHAWAR: The Peshawar High Court (PHC) on Wednesday directed the Khyber Pakhtunkhwa Environmental Protection Agency (EPA) to remove 20 base transmission system towers and microwave antennas of mobile phone companies from residential areas, as hazardous radiations cause serious diseases and health problems.

A two-member bench comprising Justice Qaiser Rashid Khan and Justice Abdul Shakoor directed the Environmental Protection Agency (EPA) director general to issue notices to mobile companies for removal order of the 20 towers and complete the removal process within one month.

EPA Director General Dr Bashir Khan submitted the report filed on the court s direction. As per the report, currently, 366 mobile towers are installed in the city, out of which 20 towers are installed at less than 25 feet distance from the residential areas, which is against the international standard.

The EPA head stated that 20 mobile towers, in particular, were riskier in terms of causing chances of hazardous radiations and health problems.

He said that 55 towers were installed near mosques, 46 near schools and 195 near residential areas. The EPA head said a majority of the mobile towers were installed in the city before 2009 and at that time there was no need of getting No-Objection Certificate (NOC) for their installation. After 2009, he added, Khyber Pakhtunkhwa adopted a strict law for granting NOCs and now towers are being set up after fulfilment of legal and preventive measures for hazardous radiations under international standards. He said that mobile towers were installed near schools and mosques within less than 100 meters, and there is no fear of hazardous radiations from the mobile towers. The EPA chief said that the International Radiation Council had also published a research report and adopted certain standards for installation and prevention of the hazardous radiations effects.

Lawyers of mobile phone companies submitted that there were less or no residential areas when the companies were installing the towers. They requested the court that mobile towers should be given protection and not to be removed.

Justice Qaiser Rashid observed that the court would not compromise on human lives and the towers need to be removed from residential areas. The high court had already stayed installation of towers near schools, hospitals and populous areas across the province and directed the provincial government not to issue NOCs to them till the next order.

Spain: Electrohypersensitivity finally considered a work-related accident

“A judge recognises the occupational nature –work accident– of an employee’s temporary disabilities derived from electrohypersensitivity”

Zaragoza, 8 January 2019. A ruling recently issued by the Juzgado de lo Social (Labour Court) No. 1 of Zaragoza, Spain, established that the sole and exclusive cause of the electrohypersensitivity suffered by an Endesa employee was his work activity. The occupational nature of the temporary disabilities granted to this employee since 2014 is therefore ascertained and said temporary disabilities are to be considered work-related accidents.

The aforementioned ruling was ratified by the High Court of Justice of Aragon. Ruling 691/2018

It is the first time that a Spanish judge recognises the occupational nature -work accident- of an employee’s temporary disabilities derived from electrohypersensitivity.

Upon receipt of an administrative request to change the status of the employee’s temporary disabilities from common illness to work-related accident, the National Social Security Institute (INSS) resolved that said temporary disabilities should be considered common contingencies.

A lawsuit was then filed to request the above change of contingency to work-related accident through the aforementioned Labour Court.

Since 2009 the plaintiff started to develop a specific biological response when exposed to non-ionizing electromagnetic fields —both high and low frequency (e.g. Wi-Fi, mobile telecommunications, WiMAX, computers, power lines, electrical transformers, etc.)—, due to limbic dysfunction. He was diagnosed with electrohypersensitivity in 2014, and thereafter every time a temporary disability took place, he was discharged from the public health system (SALUD) with the diagnosis of electrohypersensitivity as a common illness.

A work-related accident is any bodily injury that an employee suffers on occasion or as a consequence of paid employment economic activities.

This is a significant ruling as it highlights the importance of protecting particularly sensitive employees and contributes to the correct application of Article 25 of the General Law on the Prevention of Occupational Risks.

According to the latest estimates for modern societies, electrohypersensitive population ranges between 3 to 5%, bringing the total figure of people suffering from this condition in Europe to around 13 million.

On 27 May 2011 the Parliamentary Assembly of the Council of Europe passed Resolution 1815 entitled The potential dangers of electromagnetic fields and their effect on the environment.

Blumenthal criticizes the FCC & FDA for inadequate answers on outstanding public health questions

[WASHINGTON, DC]— During today’s Senate Commerce, Science, and Transportation Committee hearing on the future of 5G wireless technology and their impact on the American people and economy, U.S. Senator Richard Blumenthal (D-CT) raised concerns with the lack of any scientific research and data on the technology’s potential health risks. Blumenthal blasted the Federal Communications Commission (FCC) and the Food and Drug Administration (FDA)—government agencies jointly-responsible for ensuring that cellphone technologies are safe to use—for failing to conduct any research into the safety of 5G technology, and instead, engaging in bureaucratic finger-pointing and deferring to industry.

In December 2018, Blumenthal and U.S. Representative Anna G. Eshoo (CA-18) sent a letter to FCC Commissioner Brendan Carr seeking answers regarding potential health risks posed by new 5G wireless technology. At today’s hearing, Blumenthal criticized Carr for failing to provide answers, and instead, just echoing, “the general statements of the FDA, which shares regulatory responsibility for cell phones with the FCC.” Blumenthal also decried the FDA’s statements as “pretty unsatisfactory.” A PDF of Carr’s complete response is available here.

During an exchange with wireless industry representatives, Blumenthal asked them whether they have supported research on the safety of 5G technology and potential links between radiofrequency and cancer, and the industry representatives conceded they have not.

“If you go to the FDA website, there basically is a cursory and superficial citation to existing scientific data saying ‘The FDA has urged the cell phone industry to take a number of steps, including support additional research on possible biological effects of radio frequency fields for the type of signals emitted by cell phones.’ I believe that Americans deserve to know what the health effects are, not to pre-judge what scientific studies may show, and they also deserve a commitment to do the research on outstanding questions,” said Blumenthal. “So my question for you: How much money has the industry committed to supporting additional independent research—I stress independent—research? Is that independent research ongoing? Has any been completed? Where can consumers look for it? And we’re talking about research on the biological effects of this new technology.”

At the end of the exchange, Blumenthal concluded, “So there really is no research ongoing. We’re kind of flying blind here, as far as health and safety is concerned.

In November 2018, the National Toxicology Program released the final results of the longest and most expensive study to date on cellphones and cancer. Those studies found “some evidence” of a link to cancer, at least in male rats. However, the study only focused on the risks associated with 2G and 3G cell phones. The latest 5G wireless technology relies on the deployment of many more new antennas and transmitters that are clustered lower to the ground and closer to homes and schools. There has been even more limited research with respect to the health ramifications of 5G technology, and the FCC has thus far failed to adequately explain how they have determined 5G is safe. «
